THE COMPLAINTS COMMISSION OF THE PRESS COUNCIL IN BIH

11 citizens' complaints on writings of print and online media received in total

 

The Complaints Commission of the Press Council in Bosnia and Herzegovina held its forty sixth session on 13.01.2012 during which it considered citizens' complaints on the writings print and online media, received in the period December 2011 - January 2012. 11 complaints total were received, out of which 7 were considered at the session, while 4 were resolved through mediation. 

The Complaints Commission upheld 4 complaints where a breach of the Press Code of BiH was found, while 2 complaints were not upheld being that they did not breach the Press Code of BiH. One complaint was returned for procedure for additional review. 

Complaints upheld:

1. Mr. BERISLAV JURIC – portal JAVNO.BA: complaint regarding the taking of the complainant’s article from the portal Bitno.ba which was published on the portal Javno.ba on 23.12.2011 under the title “Fine for Camber and Farewell to Kaplan”. The Complaints Commission found breach of Article 4 - Author’s rights, of the Press Code of BiH.

2. Mr. DARIO NOVALIC – daily “DNEVNI AVAZ”: complaint regarding the article “SDA Gave 89,500 KM From the Budget to the Owner of ‘Start’” published on 5/6.11.2011 in the daily “Dnevni Avaz”. The Complaints Commission found breach of Article 5 - Accuracy and Fair Reporting, Article 7 - Opportunity to Reply, and Article 10 - Persons Charged With Criminal Offenses, of the Press Code of BiH.

3. Mr. DARIO NOVALIC – daily “DNEVNI AVAZ”: complaint regarding the article “Obhodjas Promised to Turn Himself In” published on 09.11.2011 in the daily "Dnevni Avaz". The Complaints Commission found breach of Article 5 - Accuracy and Fair Reporting, Article 7 - Opportunity to Reply, and Article 10 - Persons Charged With Criminal Offenses, of the Press Code of BiH.

4. Mr. DARIO NOVALIC – daily “DNEVNI AVAZ”: complaint regarding the article “The Audit Office Confirmed the 89,500 Mark Robbery” published on 08.11.2011 in the daily "Dnevni Avaz". The Complaints Commission found breach of Article 5 - Accuracy and Fair Reporting, Article 7 - Opportunity to Reply, and Article 10 - Persons Charged With Criminal Offenses, of the Press Code of BiH.

Complaints not upheld:

1. Mr. LEO PLOCKINIC – portal SARAJEVO-X.COM: complaint regarding the article “Petar Jelec: The Condition for BiH to Function is the Elimination of RS and FBiH” published on 23.12.2011 on the portal Sarajevo-x. The Complaints Commission considered the complaint and concluded that the Press Code of BiH was not breached.

2. Mr. LEO PLOCKINIC – portal ABCPORTAL.INFO: regarding the article published on 23.11.2011 on the portal ABCPORTAL.INFO, under the title “ULPPBHB Sends Support to Leo Plockinic”. The Complaints Commission considered the complaint and concluded that the Press Code of BiH was not breached.

1 complaint returned for further procedure:

1.    Mr. DAMIR LICINA and Mr. DAMIR PIRIJA: complaint regarding the article “Irma’s Last Message on Facebook: That’s All Folks” published on 05.01.2012 in the daily “Dnevni Avaz” and on the portal www.dnevniavaz.ba. The complaint was returned for further review.

Complaints solved through mediation:

1. Mr. BERISLAV JURIC – portal OTVORENO.BA: complaint regarding the taking of the complainant’s article “Fine For Camber and Farewell to Kaplan” from the portal Bitno.ba and publishing it on the portal Otvoreno.ba on 23.12.2011 without citing the source or the author of the article. After mediation of the Press Council in BiH, an apology for the unintentional mistake was sent to editor Juric and the source Bitno.ba was cited in the article.

2. VALICON BRANCH FOR BIH – portal POSKOK.INFO: complaint regarding the article “Gemius and Valicon Cheater on the Print: We Are More Reliable than Google!” published on 13.12.2011 on the portal Poskok.info. The denial was published on 12.01.2012 under the title “DENIAL: We Want That You Publish That We Offer Reliable Indicators for Media Planning of Marketing Activities”

3. VALICON BRANCH FOR BIH – portal POSKOK.INFO: complaint regarding the article “24SATA.INFO: Slovenian Valicon Racketeered Portals in BiH” published on 01.12.2011 on the portal Poskok.info. The denial was published on 12.01.2012 under the title “DENIAL: We Want That You Publish That We Offer Reliable Indicators for Media Planning of Marketing Activities”

4. VALICON BRANCH FOR BIH – portal POSKOK.INFO: complaint regarding the article “Gemius Manipulates With Ratings Data of Internet Portals in BiH” published on 27.11.2011 on the portal Poskok.info. The denial was published on 12.01.2012 under the title “DENIAL: We Want That You Publish That We Offer Reliable Indicators for Media Planning of Marketing Activities”
